What determines whether there is going to be a lawsuit or not?
Many elements are considered in determining whether a situation of neglect or abuse can proceed to a legal claim. Pursuing a lawsuit can be very costly, with most states requiring expert testimony in support of the claim. Many states, such as Texas, also have tort reform laws which limit the maximum damages recoverable in many situations.
